2. Registration and Agreement
2.1 These general terms and conditions apply to all proposals, Agreements and services provided by Motion Wheel. Before entering into the Agreement, the Lessee is provided with these terms and accepts them through the registration process or by signing the Rental & Handover Record.
2.2 Motion Wheel and the Lessee conclude an Agreement based on a completed registration form at motionwheel.ie or the signed Rental & Handover Record. The Agreement records the Bike, daily or weekly rental type, Rent, deposit, any additional costs and payment method.
2.3 The Agreement is established on completion of registration and payment of the first rental term, on signing the Rental & Handover Record and making the agreed payment, or when Motion Wheel starts performance at the Lessee’s request. Consumers entering an Agreement at a distance or off-premises may have a statutory cancellation right. Any request to begin services during an applicable cooling-off period and any proportionate payment for services supplied must comply with applicable consumer law. Nothing in these terms limits statutory consumer rights.
2.4 The Lessee is responsible for passing on any changes to their details as known to Motion Wheel, including changes to address, email or phone number.
2.5 The general terms & conditions remain in effect if Motion Wheel does not strictly apply one or more of these provisions in a specific case.
3. Lease
3.1 The Agreement will specify a Daily Rental or Weekly Rental. Daily Rentals have an agreed return date and time recorded in the Rental & Handover Record; an extension requires Motion Wheel’s agreement. Weekly Rentals continue on a weekly basis until terminated under Article 10.
3.2 The Personal Use Lease permits the use of the Bike for up to 250 kilometres per week. It is intended for everyday use, such as commuting and leisure cycling. It is not intended for commercial or Heavy Use, such as food delivery. The Bike models to which Personal Use applies are set out in Appendix 3.
3.3 Heavy Use and commercial use, including food delivery, are not permitted for any model listed in Appendix 3.
3.4 Motion Wheel reserves the right to inspect the Bike periodically and assess its use. If the Bike is used commercially or its average use exceeds 250 kilometres per week, Motion Wheel may apply the charges in Appendix 2(k) and terminate the Agreement.
4. Remuneration, charges and payment
4.1 The Lessee will pay Motion Wheel the previously agreed Lease and additional costs in advance. All prices include VAT.
4.2 Motion Wheel reserves the right to change its fees. In such cases, the Lessee cannot terminate the Agreement unless the increase takes place within three months after concluding the Agreement and the Lessee is a consumer. Increases based on legislation, such as VAT rises, can be implemented immediately and do not give the Lessee the right to terminate the Agreement.
4.3 The Lessee will only be charged the agreed costs except when the Lessee owes the Lessor damages.
4.4 The Lessee must pay a refundable Security Deposit before collecting the Bike: €250 for a Daily Rental or €200 for a Weekly Rental, for every model. No joining fee is payable. Motion Wheel will inspect the returned Bike and Accessories and refund the deposit, less any properly due deductions, within seven working days after return and inspection. Inspection will be completed promptly after return. Fair wear and tear will not be charged. Motion Wheel will provide an itemised explanation of deductions. Any retained deposit must be credited against the outstanding amount for the same loss or charge, not added on top of it.
4.5 The rental period begins when the Bike is collected. For a Weekly Rental, recurring payments fall on the weekday on which the Bike was collected; for example, a Monday collection gives a Monday payment date. Daily Rent and the booked return date and time are recorded in the Rental & Handover Record. Daily extensions require agreement and are charged at the agreed daily rate.
4.6 The amount due on the invoice will be collected by debiting your bank card on record. If Motion Wheel cannot collect the due amount from the Lessee via the card provided on the calendar day as referred to in Article 4.5, the Lessee is legally in default. Motion Wheel will then attempt to collect the amount owed via direct debit for a second time the day after the first direct debit. If the second collection is not successful, Motion Wheel will terminate its obligations towards the Lessee, collect the Bike from the Lessee and charge a fee of €80. Motion Wheel will also have the right to terminate the Agreement.
4.7 Before terminating the Agreement, Motion Wheel will send the Lessee a one-off reminder with a final payment term of 3 days, without charge. If the invoice has not been paid hereafter, Motion Wheel will have the right to claim legal interest and extrajudicial costs.
4.8 Repeated non-payment of the Lease will result in the following sanctions: 1st offence: a formal warning. 2nd offence: a fine of one week’s Lease. 3rd offence: termination of the Lease.
4.9 It is not permitted to use a prepaid credit card to pay for a Motion Wheel rental subscription. Any new subscriptions made using a prepaid credit card will be cancelled and any payments refunded. A customer may not change their payment method for an existing subscription to a prepaid credit card.
5. Bike and accessory collection
5.1 Motion Wheel will make the Bike and Accessories available to the Lessee in accordance with the Agreement.
5.2 The Bike and Accessories must be collected from Motion Wheel’s Workshop during regular opening hours. Collection of the Bike by the Lessee is free of charge. The collection date of the Bike is considered to be the start date of the Agreement.
5.3 The Lessee must return the Bike and Accessories to Motion Wheel’s Workshop when their Lease ends. The Lease will not be considered to have ended until the Bike and Accessories have been returned to the Workshop, and the Lessee will continue to be charged Rent until they have been returned.
6. Lessee obligations
6.1 The Bike may only be used in accordance with its nature and purpose. The Lessee will treat the Bike and any parts thereof (including the keys) with care. Bikes cannot be used on terrain for which they are not intended. Batteries should be charged in the correct way in a safe place to prevent overheating or fire hazard.
6.2 The Lessee is not allowed to sublet, loan, rent out, sell or encumber the Bike.
6.3 The Lessee must return the Bike in the same condition as they received it. Lessees are not allowed to modify the Bike themselves, and that includes not adding bike racks or child seats.
6.4 The Lessee should not continue to ride the Bike if it has a defect that using the Bike would make worse. The Lessee should instead follow the instructions in Article 7.
6.5 The Lessee must always secure the Bike against theft by correctly and properly using the locks provided by Motion Wheel.
6.6 The Lessee must always secure the battery against theft by removing it from the Bike whenever the Bike is locked in a public place.
7. Maintenance and repairs
7.1 Motion Wheel will provide regular maintenance of the Bike throughout the lease period.
7.2 Motion Wheel reserves the right to check the condition of and make modifications to its Bikes. The Lessee is obliged to cooperate with inspections, modifications and checks.
7.3 It is the Lessee’s responsibility to conduct reasonable checks to verify that the Bike remains in good and safe condition throughout the lease period, e.g. tyre pressure, brakes, working front and rear lights, no obvious damage or defects.
7.4 The Bike must be serviced at regular intervals to ensure it remains in good and safe condition. The Lessee is obliged to present the Bike for servicing by Motion Wheel on or before the Bike’s next service date, or after a period of no longer than 3 months since its previous service, whichever comes first. Servicing is provided free of charge at Motion Wheel’s Workshop, but Motion Wheel reserves the right to charge a fee for call-outs (see Appendix 2(j)).
7.5 The Lessee must report any defects or damage to Motion Wheel within 24 hours and follow Motion Wheel’s reasonable instructions, including but not limited to cooperating in a police report (by Motion Wheel), providing a completed and signed damage claim form signed by all parties involved if the damage was caused by a third party, and providing all necessary information to Motion Wheel and its insurer.
7.6 The Lessee may not have a third party repair the Bike unless it has permission from Motion Wheel.
7.7 Motion Wheel will assess the cause of the defect or damage and repair the Bike, unless it cannot be reasonably expected to do so. If the Bike cannot be repaired right away, Motion Wheel will contact the Lessee to plan a replacement within 48 hours. The Lessee cannot derive any rights if this term is not met.
7.8 Regular maintenance is at Motion Wheel’s expense unless the defect or damage is attributable to misuse by or on behalf of the Lessee. Any repair, maintenance or replacement charge arising from such damage remains subject to the relevant limits in Appendix 2, including the €250 bike-damage limit excluding the battery.
7.9 Motion Wheel is the sole arbiter of damage caused to the Bike. The Lessee will not be held liable for the cost of repair where it is deemed by Motion Wheel to be a result of fair usage and wear and tear.
7.10 In cases of improper use of the Bike by the Lessee, Motion Wheel is entitled to take measures, including the immediate collection of the Bike, without releasing the Lessee from their payment obligations. The term improper use includes use of the Bike in violation of these general terms and conditions and use contrary to the normal use of a Bike, including under the influence of narcotics such as alcohol and/or drugs, cases of traffic violations, negligence or lack of normal care or maintenance.
7.11 Motion Wheel will only exchange or repair the Bike if the Lessee has fulfilled all their financial obligations.
7.12 Motion Wheel will only repair or replace the Bike within the Operating Zone, as defined in these terms.
7.13 Motion Wheel will repair or replace the Bike at the Workshop at no additional fee to the Lessee. If the Lessee requests a call-out service, Motion Wheel may charge a fee as set out in Appendix 2(j). If the Lessee fails to attend a scheduled call-out service, Motion Wheel reserves the right to charge the full service amount.
7.14 The expected wait times in Appendix 2(j) are indicative and non-binding. Motion Wheel is not obliged to compensate the Lessee if the expected wait times are not adhered to.
8. Damage and accidents
8.1 The Lessee shall report damage to (parts of) the Bike and/or battery to Motion Wheel within 24 hours of the accident occurring or of becoming aware of the damage, unless the Lessee is prevented from meeting this deadline due to exceptional circumstances as a result of which the Lessee was reasonably not capable of reporting such damage, for example in the event of a hospital stay after an accident. This applies regardless of the extent of the damage or accident and regardless of whether the Lessee has caused the damage or accident or not.
8.2 For damage to the Bike or its parts, excluding the battery, the Lessee may be charged the cost of repair up to a maximum of €250 for every model, as set out in Appendix 2(e). Battery loss or damage is dealt with separately in Appendix 2(f), subject to the inclusive theft charge in Appendix 2(g) and 2(h).
8.3 Motion Wheel reserves the right to claim from the Lessee compensation for any losses arising as a result of a failure by the Lessee to notify Motion Wheel about damages or accidents or failure to notify within the aforesaid timeframe. This includes all additional expenses incurred by Motion Wheel for the purposes of repairing the damage as well as third parties’ compensation claims which would have been avoided if notice of the defect had been given within the aforesaid timeframe.
8.4 For damage beyond fair wear and tear, or damage caused by the Lessee in an accident, Motion Wheel may claim its actual repair loss, subject to the €250 maximum bike-damage charge excluding the battery and the separate battery limit in Appendix 2(f).
8.5 If there is any damage caused by the contributory fault or fault of a third party, the Lessee will be obliged to submit to Motion Wheel, within 24 hours from the moment the Lessee became aware of the damage or from the moment of the accident, the contact details of this third party as well as a sketch of the scene that has been agreed by both parties. Motion Wheel reserves the right to charge the Lessee for all costs and damages arising as a result of a failure by the Lessee to provide the contact details of the third party or to submit an accident report.
9. Theft, loss and liability
9.1 The Lessee acknowledges and agrees that the use of the Bike is at the Lessee’s sole risk, and accepts full responsibility for any and all liability, claims, or damages arising from its use. Motion Wheel shall bear no responsibility for any injury, loss, or damage incurred during the use of the Bike.
9.2 The Lessee will be provided with locks and keys and is expected to use the locks correctly to keep the Bike secure at all times. The U-lock must be secured around the bike frame and a fixed object, such as a cycle parking stand.
9.3 The Lessee is not permitted to leave the Bike in a public place overnight, even if the Bike is locked securely using the locks provided.
9.4 The Lessee must remove the battery whenever the Bike is locked in a public place, in accordance with Article 6.6. If the Bike is stolen with its battery during the Lease, the total theft charge is €1,200 including the battery; no separate battery-loss charge is added for that theft.
9.5 In the event of the loss or theft of the Bike and/or the battery, the Lessee is obliged to: (a) report the loss or theft to Motion Wheel within 24 hours from the moment the Lessee became aware of it; (b) return the key(s) to the Bike to Motion Wheel without undue delay; (c) report the loss or theft to the police; and (d) provide any relevant information regarding the loss or theft without undue delay upon Motion Wheel’s request. Only if all relevant requirements in this Article 9.5 have been complied with will the Lessee receive a replacement Bike from Motion Wheel.
9.6 The Lessee must inform Motion Wheel of the theft or loss of the Bike within 24 hours and follow Motion Wheel’s reasonable instructions, including but not limited to cooperating in a police report and providing all necessary information to Motion Wheel and its insurer.
9.7 For theft of the Bike during the Lease, the charge is €1,200 for every model, including its battery, regardless of whether it was double-locked, single-locked or unlocked. Appendix 2(h) applies. Any retained deposit is credited against the amount owed. Charges for theft by the Lessee and theft or loss of the same Bike are not cumulative.
9.8 If the Bike is found after a theft was reported, the Lessee will be charged a €50 processing and administration fee instead of the deductible.
9.9 Motion Wheel will inspect the Bike on return for damage or missing parts. The Lessee may provide the handover record, photographs or other evidence of pre-existing damage or fair wear and tear. Any charge for damage attributable to the Lessee remains subject to Appendix 2: a maximum of €250 excluding the battery, with separate battery loss or damage up to €500. The inclusive €1,200 theft charge is not increased by a separate battery charge for the same theft.
9.10 Motion Wheel will charge the costs of €50 to the Lessee if a Bike has to be collected from police storage.
9.11 Following theft or loss, Motion Wheel may request keys and any damaged locks as evidence of the circumstances. Locking status does not change the €1,200 charge under Appendix 2(h).
9.12 Failure to produce keys or damaged locks may be considered when investigating the circumstances, but does not increase the charge stated in Appendix 2(h).
9.13 Separate battery loss or damage is chargeable up to €500 under Appendix 2(f). If the Bike and its battery are stolen together, the battery is included in the €1,200 theft charge and no separate battery charge applies for that event.
10. Duration and termination
10.1 A Weekly Rental is concluded for an indefinite period unless both parties agree otherwise in writing. A Daily Rental is booked until the agreed return date and time; any extension requires agreement with Motion Wheel.
10.2 The Lessee may terminate a Weekly Rental by emailing info@motionwheel.ie. Weekly payments continue until the Bike is returned; there is no partial refund for a return in the middle of a paid rental period, subject to applicable statutory rights. For a Daily Rental, the Bike must be returned by the booked return date and time. Agreed extensions are charged at the agreed daily rate. Any unagreed late return does not create an authorised extension; the Lessee remains obliged to return the Bike and pay the agreed rental rate for the period of continued possession, without duplicate recovery for the same loss.
10.3 In the following cases, Motion Wheel can terminate the Agreement extrajudicially and with immediate effect, without owing any damages and while retaining its rights: the Lessee does not comply with this Agreement; the Lessee has been declared bankrupt or been admitted to a debt restructuring scheme; circumstances arise of such a nature that compliance with the Agreement is impossible or that Motion Wheel cannot be compelled to continue the Agreement as is.
10.4 Until the agreed termination or return date, the Lessee remains liable for agreed Rent. Motion Wheel will discuss return arrangements with the Lessee. The Bike must be returned no later than that date and time, and the Lessee must cooperate with its return.
10.5 Amounts invoiced by Motion Wheel before termination become immediately claimable on the termination date.
10.6 The Bike can be returned to the Motion Wheel Workshop by the Lessee, free of charge.
10.7 If the Bike is not returned when due, Motion Wheel may demand its return. For a Weekly Rental, continued acceptance of weekly payments may continue the Agreement unless Motion Wheel has terminated it. If the Lessee stops paying and fails to respond to a demand to return the Bike within 14 days, Motion Wheel may charge €1,200 under Appendix 2(g), including the battery, with any retained deposit credited against the amount owed. Article 10.8 also applies. The same Bike loss will not be charged twice.
10.8 If Motion Wheel terminates the Lease and the Bike is not returned within seven days of the end date, the non-return will be treated as theft by the Lessee for the purposes of the contractual charge in Appendix 2(g). The charge is €1,200 for every model, including the battery. Any retained deposit is credited against that charge. No separate charge under Appendix 2(h) or for the included battery will be added for the same Bike loss. This contractual description does not determine criminal liability.
11. Bike replacement
11.1 Replacing a Bike shall only be permitted in case of damage, defects, loss or theft of the Bike. If the Bike is stolen or lost, the Lessee is only entitled to a replacement if the Lessee is not responsible for the theft or loss.
11.2 Replacement includes the repair of defects or damage to the Bike arising during the Lease which result from fair wear and tear and normal use of the Bike; or, if necessary, the exchange of the Bike for a replacement Bike of a similar type, in each case provided that the Lessee has complied fully with these General Terms and Conditions.
11.3 There is no additional charge to the Lessee if the Bike exchange takes place at Motion Wheel’s Workshop, during Workshop opening hours.
11.4 The Lessee may request a Bike exchange, by appointment, at a location which they choose within Motion Wheel’s Operating Zone. Exchanges cannot be performed outside the Operating Zone. An additional fee will be charged for Bike exchanges which occur away from Motion Wheel’s Workshop; see Appendix 2(j).
11.5 Motion Wheel will endeavour to accommodate Bike replacement requests within 24 hours, if the request is made before 1pm on a day on which the Motion Wheel Workshop is open. The Lessee cannot claim any compensation or payment if this target time is not achieved, and may be liable to pay a Charge if they miss an agreed replacement appointment.
12. Purchase options
12.1 In the event that a Lessee decides to purchase a Bike from Motion Wheel, they can claim a discount equivalent to up to 4 weeks of their Lease payments towards the purchase, subject to the conditions outlined in this section.
12.2 The purchase discount applies to weekly Rent only and excludes security deposits and any other fees or charges. No joining fee is payable.
12.3 The offer is valid for 12 weeks from the date on which the Lease begins.
12.4 The Motion Wheel rental discount can only be applied towards the purchase of new Bikes. It is not applicable to used or refurbished bikes.
12.5 The Motion Wheel rental discount cannot be used in combination with any other discounts or special offers. It can be used with Cycle-to-Work purchases.
12.6 The Motion Wheel rental discount can be used with the lease of any bike model, towards the purchase of any new bike model; the Lessee is not restricted to purchasing the bike model which they are leasing.
12.7 Any purchase will be subject to the terms and conditions of the Motion Wheel shop.
13. Privacy
13.1 Motion Wheel processes information about the use and/or maintenance of its Bikes as well as personal details of the Lessee for the purposes of this Agreement, including a copy of the Lessee’s ID, in accordance with privacy legislation. See our privacy notice.
13.2 Motion Wheel reserves the right to install and monitor a tracking device on the Bike as a deterrent to theft and to aid the recovery of lost or stolen Bikes.
14. Ownership
14.1 Motion Wheel retains ownership of the Bike and Accessories. Upon termination of the Agreement, the Lessee will hand over the Bike and Accessories to Motion Wheel. This obligation cannot be delayed.
15. Liability
15.1 Motion Wheel is never liable to compensate the Lessee for any damages other than damages payable in accordance with the legislation. Motion Wheel is not liable for damages of the Lessee due to improper use of the Bike and/or battery as referred to in these conditions.
15.2 Motion Wheel is only liable for damages caused by a defect to the Bike if the defect was already present when the Agreement was entered into and Motion Wheel was or should have been aware of the defect, or if the defect was caused after the Agreement was entered into but was nonetheless attributable to Motion Wheel. Motion Wheel is not liable for any personal damages that the Lessee can claim from their insurer or if the Lessee received another type of pay-out for them, unless Motion Wheel knew or should have known of the defect when entering into the Agreement, or the defect was caused by the intent or gross negligence of Motion Wheel.
15.3 Should Motion Wheel be required to pay compensation, this will never exceed the amount of the damages covered by insurance plus the deductible, or the invoice amount paid by the Lessee under this Agreement.
15.4 Motion Wheel uses subcontractors for the implementation of the Agreement, such as a hosting provider. Motion Wheel is not liable for any shortcomings under the Agreement if they are the result of shortcomings on the part of its suppliers.
16. Choice of law and authorised court
16.1 Irish law applies to all relations between Motion Wheel and the Lessee.
16.2 Disputes between the parties about the Agreement or about acts in connection with the Agreement will only be submitted to the authorised court in the district of Dublin.
17. Changes
17.1 Motion Wheel is authorised to change these terms and conditions. Motion Wheel must inform the Lessee of the new general conditions before they come into effect. If the amendment means that the Lessee is faced with an amendment that deviates substantially from the original, they are entitled to terminate the Agreement from the date on which the changed conditions take effect.
